Indian Tribes Deny Members Casino Benefits

Enrollment lists, carrying the names of those who meet bloodline requirements, are being challenged like never before, now that being named is equivalent to receiving a trust fund.

Most, if not all, the squabbles about gambling across the United States revolve around one central issue: who gets the money. Racinos fight over whether funds should go to horse purses or slot management; Vegas casinos fight teachers' unions over taxation, each wishing to keep revenue; morals and family values are cited as cause to deny new gambling venues by groups curiously tied to existing venues.

Perhaps one of the ugliest arguments over distribution of gambling wealth involves the Indian tribes running casinos. Struck with sudden riches, the tribal members have in many cases found themselves infected with what had been viewed as a white man's sickness: greed.

The willingness to throw one's family aside for a few extra dollars in the face of astonishing wealth is appalling. After struggling through years of abject poverty, some tribal leaders are ok with kicking their neighbors and relatives back to the impoverished hell out of which casino revenue is bringing them all, for a larger cut of pie.

Tribes across the nation are in turmoil as membership becomes a primary issue. The methods of disbursement of gambling income at Indian casinos must be filed with the Bureau of Indian Affairs, and generally involve regular stipends to tribal members.

Therein lies the problem; who is a member? Enrollment lists, carrying the names of those who meet bloodline requirements, are being challenged like never before, now that being named is equivalent to receiving a trust fund.

Some tribes determine enrollment by the decree of the tribal council. No appeal is available, no remedy if a name stricken may have a reasonable case that the person indeed is a descendant from tribal founders. The San Pasqual Tribe of California is not such a tribe; their membership is determined by BIA decision.

Yet the tribe has seen fit to exclude over 50 members, withholding casino checks due them at the rate of about $4000 per individual per month. The whole tribe is only 300 strong, so this result is significant.

Tribal leaders have decided a deceased member, Marcus Alto Sr., was adopted. The BIA ruled he was in fact full-blooded Indian, far beyond the one-eighth necessary to be listed on the enrollment.

Despite the BIA decision, families who have lived their lives on tribal lands, working in tribal offices, and grown up thinking of themselves as San Pasqual now find themselves evicted from their homes and barred from their jobs.

James Fletcher, the superintendent of the BIA in Southern California, has filed with the agency regarding a violation of rules regarding revenue sharing; if the Agency finds the violation to be accurate, they can fine the tribe or move to harsher measures.

Wouldn't it beironic if the BIA shut down the casino due to the disagreement? Might as well roast that golden goose and eat it, tribal members; it's your greed that killed it.

Get your facts right before trying to make a point. The family who is being denied has not grown up on San Pasqual nor recognized themselves as Natives until Valley View Casino started making money. Then to top it off these new comers denied true descendents from being enrolled. Take a look at each of these so called members and they don't look a bit indian. All mexicans who don't belong. So don't feel sorry for them. Jim Fletcher is corrupt and has been paid off by many. He is also responsible for the Pechanga families being disenrolled. This time facts have been checked by professional geneologists and lawyers so don't count on Fletcher to get fix this one.

Greed sure is ugly! Remember, the law will put you away if you cheat and steal. It takes time, but Justice will soon rear it's ugly head and a lot of dishonest "indians" and their greedy lawyers will be up for some prison time.

First of all I'm no immigrant. My grandparents were the first to step on San Pasqual and my great grandparents were from the real San Pasqual Valley. None of you who commented even claimed your indian heritage. You know who you are and what you aren't. No click here or gang "ese" and for the drug talk nope none of that. Don't stereotype cause if you grew up on the dirt you know claim you could have ended up in the same situation as some of the drug addicted people. All my real rez people know whats up and eventually the truth will come out. Try getting that DNA test if you're so confident.

ALLEN DOESNT KNOW WHAT TO DO, HE IS WALKING AROUND LIKE A CHICKEN WITH HIS HEAD CUT OFF, AND DIANNA, SHE WALKS LIKE SHE HAS A STICK SHOVED UP HER A**. AND AS FOR VICTORIA.. HAHAHA. THATS A LAUGHING STOCK. SHE BETTER SAVE HER $ SINCE SHE IS CHARGED WITH EMBEZZLEMENT.

It is really pathetic what is going on up there. People who have lived somewhere there whole life trying to claim they are indian when in fact they are just residence. Just because you are raised somewhere doesnt make you that. If you were raised by a tribe in africa would that make you african? No it would just make you someone who lived there. And to the earlier claim that these "NON INDIANS" just started comming around when the casion was built, notice my parenthacys cause that is ludacrise my spouse and family are more native than half of the phonies up there. They were going to tribal meetings and long enrolled before any casino was ever in talks. I know I use to have to drop him off there when there was nothing. So to the earlier claim by born and raised get your facts straight just cause you cant go to a meeting dont be so jelouse you are an uneducated ignorant idiot who is no longer worth the time it took to write this blog. And dont think you are going to hurt our family because we were going strong before the money and will continue to strive where as for you have always lived in dirt and will never change. Get off the "REZ" and get a real job, quit living off of your parents property and make something of your self.

Once again an outsider "Non-indian" trying to get in where they don't belong. Not every indian is uneducated and drug addicted. If any of you were real natives you'd know that and not be bringing down your own "people". But you're not. Just phonies jumping on the Casino band wagon. Neither of you know nothing and resort to stupid comments. And nobody from my family will be packing any bags ever we belong and started this tribe long ago. Believe it or not the majority of people from the rez are doing just fine too without casino money. You're ignorant.

All of you who have submitted comments should spend some of your stipends on learning how to write including grammar, punctuation and spelling.

You may or may not have valid issues, but mostly what I'm seeing is ignorant gibberish.

Please be educated about your family lines and your tribe. The people who claim the reservation of San Pasqual have no clue how the reservation came about. The current San Pasqual reservation is a reserve set aside by the government. It lies in Luiseno territory so it has no ties to being Kumyeyaay territory. Also southern Escondido is Kumeyaay territory so it seems to me that the people who stayed in Escondido didnt allow the government to tell them where to live. They stayed close to thier aboriginal territory. The member requirements were set up by the "lineals" parents so then why didnt they set 1/16th as the lowest bloodline?????? Everyone blames it on the Altos but in truth the Altos had to fight to get recognized and werent successfully allowed to participate until the early nineties, far before any talks of a casino. Im sure some lineals were born before then, how come your parents didnt welcome you in???? oh and if they forgot to tell you the tribe did have a vote to lower the bloodline, the Altos voted to lower it and guess what your parents voted against it because it would take benefits away from them. Dont believe what you hear believe authentic documents. Diana claims to have a baptismal record showing marcus sr. is adopted well i have a census record showing her ancestors are squatters from Sonora Mx???? So whos really San Pasqual????? all the old timers in Escondido know the truth, you should ask them.
Posted by: tribal memberWhen: 09/16/2008 07:23:11 PM EST
KumeyaayNeophyte: Applause to that.

Diana Martinez is a squatter from mexico is it 'trying' to benefit all of her mexican family because she really isnt native.

how much do san pasqual indians make a month in stipends?

I have tried to stay out of this mess because I am not a member of the tribe, my husband is. I am glad that some of you have made it work, but we are not in that boat. We both work in education and are struggling to make ends meet. With the economy like it is, my Masters Degree in Special Education is not getting me very far. We decided that I would stay home with our newborn son this year and I would only work one day a week. We were not worried because it was only a year and we could lean on his extra money. Right after we made that decision, the extra money stopped. At this point we are hoping that we don?t foreclose on our tiny little condo and that we could food on the table. To those of you fighting against this family, I hope you remember that this could happen to you and it is not fun. For those you in my same boat, hang in there, karma has a way of coming around. Stay positive and stick together and we will make it through this. Pass on the values of the Circle of Courage to your children and we can be the change we wish to see in the world. Blessed Be!
