It is common practice in judicial decisions to take into account the cause of crimes, and, when addiction to alcohol or drugs is involved, try to treat the illness rather than jail the addict. Nevada is finally taking steps to see that sufferers of problem gambling might have the same option to get therapy for their disease.

The state Assembly passed a new resolution Friday, allowing a judge the option to sentence convicted criminals to treatment and supervision, if he determines compulsive gambling contributed to the offense. Judges would also have options regarding restitution, community service, and the chance to approve either confined or outpatient therapy.

Carol O'Hare, the executive director of the Nevada Council on Problem Gambling, said, "The reason it matters is that we're talking about people with a mental health diagnosis. Simply punishing them doesn't change anything."

The bill would address complaints by experts who say gambling disorders lie in the same category as substance abuse, and should be handled accordingly. Crimes such as embezzlement, fraud, and forgery often are the result of untreated addiction, and problem gambling is part of that.

The measure now advances to the state Senate, and, if passed, to the governor for signature. It passed the Assembly by a 34-8 vote, lending credence to those who believe it will easily become law.
