Potential Slots Reclassification Has Indian Casinos Outraged

All participants seemed in agreement that the change in classification was both unwarranted and ill-advised.

Oklahoma legislators, gaming officials, and Indian representatives were in an uproar this week as federal executives considered changing the definitions of Class II and Class III gambling, particularly in relation to slot machines.

The National Indian Gaming Commission is debating whether to reclassify certain bingo-based Class II slots as Class III, a move which would have consequences throughout Indian lands across the country, but especially so in Oklahoma. In Oklahoma, over half the slots in play would become the Class III machines, which are not allowed.

Brian Campbell, CEO of Chickasaw Enterprises, said complying with the proposed changes would cost his tribe over $30 million.

Tom Cole, a Republican Representative from Oklahoma, said, "The regulations are a solution in search of a problem. It will cripple economic development in Indian Country, not promote it."

Wednesday's hearing before Cole and Democratic Representative Dan Boren resulting in a tumultuous turnout, but all participants seemed in agreement that the change in classification was both unwarranted and ill-advised.

The NIGC did not give reason for the suggested changes, although represetatives did downplay the potential effect on Indian casinos. However, considering the overall policies of the Department of the Interior and Secretary Dirk Kempthorne, this may be seen as another attempt to limit and reduce Indian gaming, regardless of the consequences upon tribes.

Tribal leaders did indicate legal action may follow if the NIGC follows through.

The commission did extend the discussion period through March 9th. Phil Hogen, the NIGC chairman who recently suffered a mild stroke, would then announce a final decision at some point past that date.
