Casinos Face Frivolous Second-Hand Smoke Lawsuits
A suit filed in US District Court in Las Vegas marks the second action by casino employees against their employers for subjecting them to the dangers of second-hand smoke. Wynn Casino employee Kanie Kastroll charges that smoking permitted to patrons causes her to suffer ill effects.
The suit was filed by KamberEdelson, a law firm that in July charged Caesars Palace with a similar violation. The law firm is attempting to get the suits classified as class-action cases, which would greatly increase the profit the trial lawyers might make if they can convince a court that the unconfirmed effects of second-hand smoke were forced upon employees who chose to work at the casinos.
An examination of the studies on second-hand smoke reveal conflicting data, with advocate groups distorting and cherry-picking results to present a supposedly settled picture of the unhealthy effects of being in smoking areas. But legal evidence is likely to be introduced by the casinos establishing that harmful results of exposure have not been proven to occur.
While some accuse casinos of blindly seeking money over the health of individuals, certainly the same quest for a dollar can be laid on trial lawyers. And no one can deny that no one is required to choose to work in a casino, on the gaming floor.
The lawsuit says, "Dealers who tell customers that second-hand smoke bothers them will likely be subject to discipline."
But likelihood is not a base for suing. If greedy lawyers and anti-smoking fascists want to impose lifestyle choices on individuals and control the clientele of private businesses, perhaps they won't mind a lawsuit against them for causing irritation to common sense.

| Sorry Preston, but you really suck in this story... To say that the studies on second hand smoke have conflicting data is LUDICROUS ! The OVERWHELMING verdict by the EPA, WHO, CDC, and responsible scientists around the world is that second hand smoke (SHS) causes premature death and disease. Casinos in Las Vegas will eventually have to ban smoking as they have in Atlantic City, not so much in fear of lawsuits, but because they're health insurance costs will go through the roof as their long-time employees get sicker ansd sicker. And calling anti-smoking activists "fascists" is juvenile and insulting. I am a non-smoking musician who has COPD from working in smokey bars and casinos my entire adult life, and now cannot get health insurance (pre-existing condition). Casino employees have a right to clean air. Tobacco smoke has OVER 40 known carcinogens. The least casinos can do for now is put oscillating fans behind each dealer to blow the smoke away from the table. | |

| There's a saying in corporate circles " the employees will let the company know when we`ve pushed them to far". This wall-mart mentality has been perpetrated on casino dealers for years. The casino industry is much different than any other business and should never have gone down this path. This could just be the beginning of disgruntled casino workers exposing the industries social and ethical privileges we`ve taken for granted. Lets not be so concieted and naive to call this suit frivolous. The industries best bet now is to try and mend these relationships. | |

| No mention in the NIOSH study that NNAL comes from potatoes, tomatoes, grain, eggplant; how they account for that confounder. "urinary COT levels adjusted for creatinine for all three casinos combined decreased over an 8-hour shift." This, during the weekend evening shift! If they had nnal in their blood, and it went down after 8 hours, how is there significant exposure? The dealers telling what they feel like in a written survey; then that statement used as a medical opinion , thats not scientific or exact: but thats the study Anti-smokers are using as "proof". | |
