Kentucky Judge Refuses to Dismiss Online Gambling Case
Kentucky Judge Thomas Wingate denied the multitude of requests he received to dismiss the online gambling suit before him today. The judge ordered that arguments be presented before him on November 17th to decide on whether he will give the state control of 141 Internet casinos and gambling sites domain names.
Attorneys representing diverse interests including online gambling sites, Internet freedom groups, libertarians, and business groups promoting a censorship-free Internet had petitioned the judge to dismiss the case, on grounds ranging from violations of the Commerce Clause of the Constitution to lack of proper jurisdiction.
Wingate did mention the possibility that online casinos not blocking access to Kentucky citizens may forfeit domain names. This may lead to a conclusion that blocking Kentucky may be enough to salvage domain names from the state's grasp.
